1. Provider and scope

These terms apply to the use of the website goldswap.info and the GoldSwap.Info software. The provider is:

GoldSwap.Info is intended for businesses, self-employed people and organisations that do marketing via Facebook, Instagram, email and SMS.

2. Services

GoldSwap.Info is online software (software as a service) for Messenger and Instagram bots, automatic replies to comments and messages, post scheduling, email and SMS campaigns and in-chat shops. The exact scope and limits depend on the plan chosen on the pricing page.

Features that use Facebook or Instagram depend on Meta's APIs and policies. If Meta changes or restricts these APIs, individual features may be limited; we are not responsible for this.

3. Registration and trial

A customer account with truthful information is required. Keep your login details secret. New customers can try GoldSwap.Info for free; access ends after the trial unless a paid plan is booked.

4. Prices, payment and term

The prices in euros shown on the website at the time of booking apply. Payment is made in advance via PayPal or Stripe. Plans run for 30 or 365 days. With recurring payment the plan renews automatically for the same term until you cancel. You can cancel at any time effective at the end of the current period – in your PayPal or Stripe account or by email to mail(at)goldswap.info. Periods already paid are not refunded pro rata unless required by law.

5. Customer obligations

• You comply with Meta's terms and platform policies (Facebook, Instagram, Messenger).
• You send messages, emails and SMS only to recipients who have consented or where another legal basis exists. Spam is prohibited.
• You do not distribute unlawful, misleading or offensive content or content that infringes third-party rights.
• You are responsible for the personal data of your contacts and subscribers. We process it on your behalf; a data processing agreement is available on request.

In case of serious violations we may suspend the account, in particular if Meta or a service provider requires us to do so.

6. Availability

We aim for uninterrupted operation. Maintenance, outages at Meta or at payment, email or SMS providers and force majeure may temporarily limit availability.

7. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Customers are responsible for the content they send or publish with the software.

8. Termination and deletion

You can close your account at any time. After the contract ends we delete your data unless statutory retention obligations apply. Export any data you want to keep beforehand.

9. Changes

We may change these terms with effect for the future, e.g. for new features or legal changes. We will inform registered customers of material changes by email in good time.

10. Governing law and jurisdiction

The law of the Republic of Estonia applies. Mandatory consumer protection rules of the country where you as a consumer have your habitual residence remain unaffected. If you are a business, the place of jurisdiction is Tallinn.
